11.3 A failure by Artfinder to enforce or exercise at any time or for any period of time any term of or any right pursuant to these Terms does not constitute, and shall not be construed as, a waiver of such term or right and shall in no way affect Artfinder’s right later to enforce or exercise it.

11.4 If any provision of these Terms is found to be illegal, invalid or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining provisions, be deemed omitted from these Terms and shall in no way affect the legality, validity or enforceability of the remaining provisions.

11.7 No variation to the scope or provisions of these Terms shall take effect unless agreed in writing by both parties.

11.8 Nothing in these Terms shall create or be deemed to create a partnership, an agency or a relationship of employer and employee between the parties.

11.9 These Terms (and all non-contractual relationships arising out of or connected to them) shall be governed by and construed in accordance with English law.
