Social media competition terms
ELIGIBILITY: Social Competitions are open to residents in European Union, United States of America, Canada and Australia aged 18 and over. Entrants must successfully complete the steps as set out in the Social Competition post (the “Post”) to be eligible to win. The Post will set out the deadline for entering the Social Competition, the number of winners (the “Winner(s)”) and when Winner(s) will be announced. Where liking, tagging and/or comments form part of the entrant instructions as set out in the Post, any such likes, tags and/or comments must be made on the original Post from Artfinder for the entrant to be eligible to win and any likes, tags and/or comments made on a copied or shared post, or otherwise not made on the original Post, will not be counted. Social Competitions exclude employees of Artfinder and their immediate families, and anyone professionally connected to that Social Competition. The Winner(s) may be asked to provide proof of ID. No purchase necessary. Entries made from trade, consumer groups, third parties, agents, or entries automatically generated by computer will not be accepted. No bulk entries.
THE PRIZE: The Winner(s) will be eligible to receive a prize, details of which will be set out in the Post (the “Prize”). There may be one or more Prizes available to win which will be as set out in the Post. The Winner(s) will be randomly selected from all eligible entries on the Post.
Where the Prize consists of an Artfinder Gift Card, any Artfinder Gift Card amount will be issued as credit to the nominated Artfinder account and the credit must be redeemed within twelve (12) months. Prizes must always be redeemed through Artfinder within a limited time as will be explained to the Winner(s). Prizes may not be redeemed in conjunction with any other offer. No cash alternatives are available. Artfinder reserves the right to substitute a Prize for another of the same value.
Where a Prize consists of a physical product, the Winner(s) will be sent their Prize(s) in the post within two weeks of providing their address to Artfinder. A Prize will only be delivered to an address in the European Union, United States of America, Canada or Australia. Artfinder will not be responsible for any undelivered Prize(s), delays or defects in delivery for any reason, including but not limited to strikes, damage or loss of the Prize(s). Artfinder will not be responsible for non-delivery if the address you provide is incorrect or cannot be delivered to, for any reason, including if there is no one available to receive a Prize on delivery. Artfinder will not be held responsible for any injury, loss or damages resulting from any Prize(s) that may have been caused by any issues in relation to a Prize.
Winner(s) are always selected in random draws which will take place after the Social Competition has closed. He/she/they will be announced as the Winner(s) on the original Post by Artfinder by the time set out on the Post. The Winner(s) must respond within the timeframe set out in the post announcing the Winner(s) in order to accept their Prize, after which that Prize will no longer be open to acceptance and will be offered to someone else. The Winner(s) must respond with their full name and email address (and postal address if required for receipt of their Prize) in order to receive their Prize. Where an address is required in order to send a Prize to a Winner, failure to provide an address within the European Union, United States of America, Canada or Australia will result in the Prize being forfeited. The redemption of a Prize is subject to availability and is subject to change at the discretion of Artfinder.
In the event that a Social Competition is run in collaboration with another brand we will notify you of this in the Post. To the extent necessary to provide Winner(s) with their Prize(s) we may need to share your personal information with the brand we collaborated with but this will only be done where the Prize(s) needs to be sent directly from the collaborating brand or where the Prize(s) must be redeemed directly with the collaborating brand. Details of this will always be drawn to your attention in the Post.
SOCIAL MEDIA SITES: By entering the Social Competition, you agree that you will release Instagram and/or Facebook of all responsibility associated with this Social Competition. The Social Competition is is in no way sponsored, endorsed or administered by, or associated with, Instagram and/or Facebook.
LIMITATION OF LIABILITY: Artfinder cannot be held responsible for non-receipt of entries due to technical problems or network difficulties. Proof of sending does not constitute proof of delivery. By participating in the Social Competition, you agree that you participate at your own risk. Except that Artfinder does not exclude or limit its liability for personal injury or death caused by its negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded, Artfinder accepts no liability in relation to an individual’s participation (or inability to participate) in a Social Competition to the maximum extent permitted by law, including any direct, indirect, incidental, consequential, or any other type of damages related to or arising from a Social Competition or your participation in a Social Competition.
SEVERANCE: If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and remain in force.
GOVERNING LAW: Social Competitions and these Terms & Conditions will be governed by and construed in accordance with the laws of England. You and we each agree that the English courts will have non-exclusive jurisdiction over any claim or dispute arising from, or related to, the Social Competition or these Terms & Conditions.
